New York Asbestos Rules: A Plain-English Guide
New York regulates asbestos work through two main sources: Article 30 of the New York Labor Law and the Department of Labor's Industrial Code Rule 56, also known as 12 NYCRR Part 56. The NYS Department of Labor (DOL) Asbestos Control Bureau enforces both. Here are the basics owners and contractors ask about most.

The law and the rule
Labor Law Article 30 sets the framework:
- Contractors on asbestos projects must hold an asbestos handling license, and their workers must hold asbestos handling certificates (Labor Law §902).
- Large projects must be reported ahead of time, with a fee (§904).
- DOL can inspect projects (§907), stop a project that isn't following the rules (§908), and seek penalties after a hearing (§909).
Part 56 fills in the details. It covers licensing and certification, surveys, notifications, air sampling, abatement work practices and variances (12 NYCRR 56-1.2). Licensing applies to more than removal crews: firms that do surveys, air sampling, project design and project monitoring also need a DOL license (56-3.1(b)).
Surveys come first
NYS DOL requires an asbestos survey before work disturbs building materials, regardless of construction date (12 NYCRR 56-5.1; DOL, NYS Asbestos Survey Requirements, P232 (1/26)).
The survey must be done by a DOL-licensed firm using certified asbestos inspectors (56-5.1(a), (e)). The owner or their agent sends a copy to the local office that issues the building permit (56-5.1(g)(1)). If the survey finds asbestos that the work will disturb, a licensed asbestos abatement contractor must remove it before the demolition or renovation starts (56-5.1(h)).
The single-family, owner-occupied exemption
Part 56 does not apply to "owner-occupied single family dwellings, where the owner performs the work" (12 NYCRR 56-1.3(a)). DOL's publication P229 says all three of these conditions must be met:
- The structure is a single-family dwelling.
- The dwelling is occupied, or going to be occupied, by the homeowner.
- The work is performed solely by the homeowner.
According to P229, a house slated for demolition isn't "occupied." Corporations, contractors and "flippers" who plan to sell or rent aren't "owners" for this purpose, and rental properties don't qualify. The exemption ends as soon as you hire someone to do the work.
Project sizes and DOL notification
Part 56 sorts asbestos projects by how much material is disturbed (56-2.1(w)(2)):

For a Large project, the licensed abatement contractor must notify the Asbestos Control Bureau in writing. DOL must receive the notice at least 10 calendar days before the work area preparation phase begins, unless DOL waives this in writing or it's an emergency (56-3.4(b)(1); 56-3.5). Notification fees are set by Labor Law §904(2):

A project measured in both square feet and linear feet pays the fee for each (DOL P224).
Site-specific variances (SH752)
When a job can't practically follow Part 56 as written (a tight crawlspace or fire debris, for example), DOL can grant a variance with conditions attached (Labor Law §30(2); 12 NYCRR 56-12.2). Where DOL has published an Applicable Variance for a common situation, it may cover the job (56-12.3). Otherwise, the owner is the petitioner on DOL form SH752, and a DOL-certified Project Designer working for a DOL-licensed firm must prepare and submit it. The filing fee is $350 (Labor Law §30(1); SH752; DOL Code Rule 56 page). When one is needed, our DOL-certified Project Designer can prepare the SH752 petition. DOL decides whether to grant it and what conditions apply. A site-specific variance generally stays in effect for one year (DOL Code Rule 56 page).
If DOL stops a job

Frequently asked questions
Do I need a survey for a small renovation?
Yes. NYS DOL requires an asbestos survey before work disturbs building materials, regardless of construction date. The main exception is the single-family, owner-occupied exemption (12 NYCRR 56-1.3(a)): a single-family dwelling, occupied or to be occupied by the owner, with the owner doing the work personally (P232 (1/26)).
Can I remove asbestos from my own house?
Only under the single-family, owner-occupied exemption (12 NYCRR 56-1.3(a)): a single-family dwelling, occupied or to be occupied by the owner, with the owner doing the work personally. DOL still recommends a licensed contractor (P229).
Who files the DOL notification?
For Large projects, the licensed asbestos abatement contractor files it at least 10 calendar days before work starts (56-3.4(b)(1)).
Does ClearVU remove asbestos?
